Privacy policy and terms of use

1. General provisions

This Policy describes how the Sell & Buy team (the “operator”, “we”) processes personal data of visitors to sellnbuy.by and users of our services (“you”, “user”).

Processing is carried out in accordance with the Law of the Republic of Belarus dated 7 May 2021 No. 99-Z “On Personal Data Protection” and other applicable regulations.

By using the site and submitting requests or messages through it, you confirm that you have read this document and accept its terms. If you disagree with any provision — please do not use the site or send us your data.

2. What data we collect

We only collect the data needed to operate the website, process your requests and provide the service.

2.1. Data you share yourself

Through the “Get early access” form and other contact channels you may share with us:

• your name or how you'd like to be addressed;
• email address;
• phone number (if you choose to provide it);
• the industry and the name of your business;
• a description of the tasks you want to solve with the platform and other information you voluntarily include in the message.

2.2. Technical data collected automatically

When you visit the site, your browser automatically sends technical information that we use in an aggregated form:

• IP address and approximate region;
• browser type, version and language settings, device type and OS;
• pages you opened, referrer, date and time of the visit;
• identifiers of cookies and similar technologies (see section Cookies and analytics).

2.3. What we don't collect

We don't ask you for data on health, political or religious beliefs, biometric data or other special categories of personal data. Payment details are not accepted or stored on sellnbuy.by.

3. Purposes and legal grounds

We process your data for the following purposes:

• Get back to you about your request. To respond to your inquiry, discuss onboarding, schedule a demo and assemble a configuration for the platform.
• Inform you about the product. With your consent we send updates about new modules, changes to terms and beta status. You can unsubscribe from any such email in one click.
• Improve the site and the service. Analyze behavior in an anonymized form to understand which sections are useful, where users get stuck and what we should fix.
• Comply with legal requirements. For example, respond to official requests from authorized bodies to the extent required by law.

Legal grounds for processing: your consent (expressed by submitting a form or message), performance of a contract (when you become our partner), and our legitimate interest in developing and protecting the service to the extent that doesn't violate your rights.

4. Retention and storage

• Your requests and correspondence are kept for as long as needed to handle the inquiry and provide follow-up service, but no longer than 3 years after the last contact, unless a different period is required by law.
• Technical logs and anonymized analytics are kept for up to 26 months.
• Data is deleted earlier if you withdraw consent or request deletion (see section Your rights) and we have no legal obligation to keep it.

Data is hosted on secured servers. We strive to keep data of customers from the Republic of Belarus on infrastructure inside Belarus or in friendly jurisdictions; in case of any cross-border transfer we apply measures providing an appropriate level of protection.

5. Sharing with third parties

We do not sell your data and do not share it with ad networks. Access to data is limited to Sell & Buy employees in the scope necessary to do their job, and to vetted contractors that help us deliver the service:

• hosting providers and infrastructure operators;
• newsletter and transactional email services;
• web analytics and uptime monitoring systems;
• payment services and acquiring banks — at the partner onboarding stage and only to the extent necessary for the integration.

We work with all such contractors under agreements that require them to keep data confidential and to use it only as instructed by us.

Disclosure to authorized state bodies is possible only based on an official request, in the manner and to the extent established by law.

6. Cookies and analytics

Cookies are small text files the site stores in your browser. They help the site work correctly and help us understand how it's used.

6.1. Consent to cookie use

In line with art. 5 of Law No. 99-Z and clarifications of the Belarusian National Center for Personal Data Protection, we split cookies into four categories and ask for your consent before setting those that require it. On your first visit you'll see a banner with the choice — “Accept all”, “Necessary only” or “Customize” by category.

You can change your choice at any time: there's a “Cookies” link in the footer that opens the settings dialog. Your decision is stored for 12 months in our own cookie file cookie_consent_v1; this file is technical and is set without separate consent (otherwise we wouldn't be able to remember your choice).

6.2. Cookie categories

• Necessary. Provide the basic site behavior: session, CSRF protection, correct form submission. Right now this is the only category actually set on sellnbuy.by. Without them the site won't work, so they're always active (legal basis — performance of a contract in the broad sense: providing you with the site).
• Functional. Remember your preferences (language, theme, collapsed elements) so you don't have to set them up on every visit. Enabled only with your consent.
• Analytics. Help us understand which pages are popular and where users get stuck. Data is aggregated and doesn't identify a specific person. Enabled only with your consent.
• Marketing. Used to pick relevant ads and partner offers — for example, to avoid showing you an offer you've already seen or accepted. Enabled only with your consent.

At the time of publication of this document we have not connected a single analytics or marketing script — so even if you click “Accept all”, nothing extra will load. When we connect such services, they will only run with your consent for the corresponding category.

Apart from cookies, the site makes requests to Google Fonts to load the Roboto font. These requests don't set cookies, but your IP address becomes known to Google at the moment of loading. We plan to switch to self-hosted fonts to eliminate this cross-border transfer.

6.3. How to manage cookies in the browser

Besides our settings dialog, you can clear or block cookies in your browser. Most browsers let you:

• delete cookies that have already been saved;
• block cookies for specific sites or for all sites;
• show notifications when a site tries to set a cookie.

You'll find detailed instructions in your browser's help (Chrome, Safari, Firefox, Edge, Yandex Browser and others). Note that disabling necessary cookies will break parts of the site.

7. Security

We apply reasonable organizational and technical safeguards: channel encryption (HTTPS/TLS), encryption of sensitive data in the database, regular backups, role-based access for staff and action logging, monitoring of suspicious activity.

If you discover a vulnerability or suspect unauthorized access to data, please email us at security@sellnbuy.space. We appreciate responsible disclosure.

8. Your rights

Regarding your personal data you have the right to:

• obtain confirmation of the fact of processing and information about it;
• obtain a copy of the data we keep about you;
• demand clarification, correction or deletion of data if it's inaccurate, incomplete or no longer needed for the processing purposes;
• withdraw your consent to processing — at any time;
• lodge a complaint about our actions with the authorized body for protection of personal data subjects' rights.

To exercise any of these rights, write to us at support@sellnbuy.space. We respond within 15 business days. In some cases we may need to verify your identity to avoid disclosing data to third parties.

9. Terms of use

By using sellnbuy.by you agree to the following rules:

• do not use the site to distribute unlawful, offensive or harmful content;
• do not attempt to gain unauthorized access to the infrastructure, bypass security systems or run load or other testing without our consent;
• do not use automated tools (scrapers, bots) in a way that creates excessive load or disrupts the site;
• provide truthful information when submitting requests;
• respect intellectual property rights: texts, images, logos and the design of the site belong to Sell & Buy and are protected by law.

The site and its materials are provided “as is”. We strive to keep information up to date but don't guarantee the site will always run without interruptions or errors. During the beta some features may change.

To the extent not regulated by a separate agreement with a partner, the relationship is governed by the law of the Republic of Belarus.

10. Changes to the policy

We may update this document — for example, when new features ship, legal requirements change or our processing approaches evolve. The current version is always available at sellnbuy.by/privacy; the effective date is shown at the top of the page.

We additionally notify our business partners about material changes by email.
